Provision

Chapter 1. General provisions

 

Article 1. Status

 

1. Tbilisi Humanitarian Teaching University is a higher educational institution established on the basis of Georgian legislation, a private law legal entity – a limited liability company, which carries out educational activities in accordance with the mission of Tbilisi Humanitarian University and these regulations.

 2. Tbilisi Humanitarian Teaching University, in accordance with Article 2, Paragraph 33 and Article 9, Paragraph 1, Subparagraph "b" of the Law of Georgia "On Higher Education", is a teaching university that does not implement doctoral educational programs.

 3. The full name of Tbilisi Humanitarian Teaching University is “Tbilisi Humanitarian Teaching University LLC”, and the abbreviated names are - "Tbilisi Humanitarian University" Teaching or "THU".

 4. The legal status of Tbilisi Humanitarian Teaching University as an entrepreneurial entity is determined by its charter.

 5. Tbilisi Humanitarian Teaching University has a seal, letterheads, stamp and bank account reflecting its name.

 6. Legal and actual address of Tbilisi Humanitarian Teaching University: Georgia, 0144 Tbilisi, Beri Gabriel Salosi Avenue No. 31.

 7. Tbilisi Humanitarian Teaching University may have branches (representative offices) on the territory of Georgia, which are established in accordance with the legislation of Georgia, are not legal entities, act on behalf of the University and on the basis of the regulations approved by the University.

 

Article 2. Legal Basis of Activity

 

1. Tbilisi Humanitarian Teaching University carries out educational activities on the basis of the Constitution of Georgia, international treaties and agreements of Georgia, the Law of Georgia "On Higher Education" and other legislative acts of Georgia, orders of the Minister of Education and Science of Georgia, educational standards, legal acts of the LEPL "National Center for Education Quality Development", these Regulations and the mission defined by the University.

 2. In the event of any discrepancy between this provision and the legislation of Georgia, the legislation of Georgia shall prevail; any amendments and additions to the legislation of Georgia that are inconsistent with an article, paragraph or subparagraph of this provision shall render the relevant article, paragraph or subparagraph of this provision invalid.

 

Article 3. Goals and Objectives

 The goals and objectives of the university are determined on the basis of the mission approved by the university and are consistent with the policy defined by the state in the field of education.

 Article 4. Subject of activity

 

 1. In order to ensure the implementation of the goals and objectives defined in the mission, the University carries out the following educational and/or related activities in accordance with the legislation of Georgia:

 a) Implementation of undergraduate educational programs;

b) Implementation of master's degree educational programs;

c) Implementation of single-level educational programs defined by the Law of Georgia "On Higher Education";

d) Production of intellectual property products;

e) Cooperation with educational and scientific institutions in Georgia and abroad;

f) Education and other related services permitted by Georgian legislation.

 

Article 5. Independence

 

The University is independent in its activities. Independence applies equally to academic and creative activities.

 

Article 6. Sources of Financing and Ownership

 

1. The sources of funding for the university are:

a) Study grants obtained by students enrolled in the university;

b) Other funds received from the university's educational activities;

c) Founder's investments;

d) Other income defined by legislation.

 

2. The property of the University is represented by the main funds recorded on its balance sheet. Educational inventory, other material and technical base; intellectual and other products (works) produced by the University, other property permitted by legislation.

 3. From the income received by the University from the activities carried out in accordance with this Regulation and the Statute of the University, the amount of funds for the functioning and development of the University shall be determined annually by the founder from the University's income, within the framework of which the annual budget of the University as an educational institution shall be drawn up.

  

Chapter 2. University Management

 

 

Article 7. University Management Principles and Governing Bodies

 

1. The principles of university management are:

 a) Publicity and accessibility of legal acts;

b) Academic freedom of academic staff and students;

c) Participation of academic staff and students in decision-making;

d) Equal treatment regardless of a person's ethnicity, gender, social origin, political or religious beliefs, etc.;

e) Fairness and transparency of elections, publicity of competitions;

f) Entrepreneurial freedom.

 2. University management bodies and officials:

 a) Founder;

b) Academic Council;

c) Rector;

d) Vice-Rector;

e) Head of Administration;

 3. The founder of the university has the right to be elected/approved to the university's governing body (to the position of rector, head of administration, member of the academic council, in the case of holding the academic position of professor or associate professor) or to be employed in another position specified in the university's staff list.

 

Article 8. Powers of the Founder

 

1. The founder is authorized to:

 a) Agree on the university's mission, strategic development and action plans - monitor and evaluate them;

 b) Agree on the university budget and submit it to the Academic Council for approval;

 c) Dismiss the current composition of the Academic Council in the event that the Council fails to make a decision on the same issue twice in a row, if this poses a threat to or hinders the functioning of the University;

 d) To familiarize oneself with the accounting and reporting documentation of the University and other documents related to the activities of the University, to conduct a financial and economic analysis of the University's activities once a year, and to schedule and conduct an audit;

 e) Receive information about the activities of the University; develop recommendations for improving the activities of the University, as necessary;

 f) Submit the candidacy/candidates for the position of Rector to the Academic Council;

 g) Submit a candidacy for the Head of Administration to the Academic Council.

 2. The special powers of the founder are determined by the statute.

 

 

 

Article 9. Academic Council

 

1. The composition of the Academic Council of the University is determined by 14 members. The Academic Council includes the Rector and Vice-Rectors of the University.

The chairman of the Academic Council is the Rector.

The faculties of the university are represented by 4 representatives elected from an equal number of academic staff; 2 members of the Academic Council are appointed by the Rector from among the academic staff; the Academic Council includes the Head of the University Library, the Head of the Research and Development Center. The Academic Council includes 1 graduate, who is represented by the Student Support and Career Development Service. The Academic Council also includes 2 students represented by the Student Self-Government, who are elected by the students through direct, free and equal elections, by secret ballot. The organization of the elections is ensured by the Student Self-Government.

 2. The term of office of a member of the Academic Council is determined by 4 years.

 3. Academic Council:

 a) Establishes the university's strategic planning methodology and mechanisms for monitoring strategic development and action plans;

 b) The founder agrees with and approves the strategic and action plans for the development of the university;

 c) Develops proposals for amendments and additions to the University Regulations;

 e) Develops and approves the structure of the university;

 f) approves the university's internal regulations, ethics and disciplinary liability norms;

 g) Develops a draft university budget and approves it after agreement with the founder.

 h) Approves the rules for hiring support staff upon the proposal of the Head of Administration, in agreement with the Rector;

 i) Approves the regulations of the university faculties, the regulations of the university's structural units, and the regulations of the Academic Council;

 j) Approves educational programs and modifies them upon submission by faculties;

 i) Promotes the integration of higher education in the European space, cooperation between higher education institutions and/or the creation of joint programs;

 k) approves the head of the administration service upon the proposal of the founder;

 l) Approves coefficients for unified national exams, in cases specified by Georgian legislation – for master's exams, as well as the number of students to be admitted to faculties, upon submission by faculties;

 n) Approves the rules for obtaining, suspending and terminating student status, mobility, as well as the recognition of education obtained during the study period;

 n) Approves the rules for providing further education to students of the relevant program in the event of a change or cancellation of the educational program;

 o) Approves the educational program implementation evaluation system upon submission of the Quality Assurance Service;

 p) elects the Chairman of the Academic Council – the Rector of the University, upon the nomination of the Founder;

 r) On the grounds of violation of Georgian legislation by the Rector, improper performance of the duties assigned to the Rector and/or implementation of activities inappropriate for the Rector, at the initiative of the founder or with the prior consent, considers the issue of early termination of the Rector's powers; The decision on early termination of the Rector's powers is made by secret ballot, by 2/3 of the full membership of the Academic Council; The Rector does not participate in the votes provided for in this paragraph; In the event of early termination of the Rector's powers, the Academic Council shall assign the duties of the Rector to the Vice-Rectors or the head of any structural unit until the appointment of a new Rector;

 s) Makes a decision on holding an open competition, including determining the date and the competition commission, upon the request of the faculties;

 t) Establishes the competition conditions, taking into account the proposals of the faculties, the requirements specified by the legislation of Georgia and these regulations;

 (u) Uses other powers conferred upon it by the legislation of Georgia and this Regulation.

 4. The rules of operation of the Academic Council are determined by the Regulations of the Academic Council.

  

Article 10. The Rector

 

1. The Rector is the highest academic official of the University, the Chairman of the Academic Council and represents the University both inside and outside the country, in academic fields, for which he is authorized to conclude deals and agreements on behalf of the University. In the event that the conclusion of a deal or agreement is related to financial and economic issues, they are also signed by the Head of Administration.

 2. The Rector is elected for a term of 5 years by the Academic Council from among the candidates/candidates nominated by the founder.

 3. The Rector, if necessary, is authorized to appoint a Vice-Rectors for the effective exercise of his/her powers;

 4. Rector:

 a) Directs and manages the activities of the University in accordance with the legislation of Georgia;

 b) Represents the University in state and other agencies, institutions and organizations, as well as with the student union, in accordance with the legislation of Georgia;

 c) Conducts negotiations, concludes agreements and signs other documents on behalf of the University; is authorized to manage inter-university relations;

 d) Controls the implementation of the University's charter, regulations, internal regulations and other legal acts in force at the University; regulates legal issues of the University;

 

e) Controls the process of implementing educational programs;

 f) Appoints and dismisses faculty deans, in accordance with the agreement of the founder, determines their tasks, rights and obligations, and controls their activities in accordance with this Regulation;

 g) In agreement with the Academic Council, based on the needs of the university, has the right to appoint advisor/advisors to the Rector;

 h) Makes decisions on personnel management in accordance with the personnel management policies and procedures established by the Academic Council;

 i) Promotes international cooperation and the internationalization process of the university;

 j) Manages and directs the process of student enrollment at the university, approves tuition fees, deadlines for the educational process, and issues relevant acts regarding student movement;

 k) In accordance with these regulations and the University Charter, implements the decisions of the Founder and the University Academic Council;

 l) Issues orders;

 m) Assigns specific tasks to heads of services by order;

 n) Exercises other powers that arise from these regulations and statutes and do not contradict the legislation of Georgia.

 5. The Rector of the University is accountable to the Founder and the Academic Council.

 6. The Rector is obliged, upon the request of the founder, to immediately provide him with information about the activities of the university and to grant permission to familiarize himself with the university's documentation.

 

Article 11. Vice-Rector of the University

1. Participates in determining the structure of the university;

2. Participates in the development of long-term (seven-year) and action plans (three-year) for the development of the university;

3. Participates in the strategic planning of the university's educational and scientific activities;

4. Coordinates the proper performance of the functions of the university's structural units;

5. Participates in the development of research and development projects;

6. Participates in the development of infrastructure renewal projects;

7. Facilitates the process of creating a system that ensures the professional growth of personnel;

8. Coordinates the development of educational programs and improvement of the learning process, together with relevant structural units;

9. Monitors and evaluates the educational/scientific process within the framework of existing quality assurance mechanisms;

10. Exercises other powers that arise from these Regulations, other regulatory acts of the University and do not contradict the legislation of Georgia.

11. The areas of responsibility of the Vice-Rectors are determined by the structure of the University.

 

Article 12. Head of University Administration

1. The administration is headed by the Head of Administration, who is the highest administrative manager of the university in the field of material and human resources (within his/her competence), who represents the university in economic relations.

 2. The Head of Administration is approved by the Academic Council upon nomination by the founder.

 3. The term of office of the Head of Administration is 4 years.

 4. Head of Administration:

 a) Participates in the university's management policy and, within the scope of his/her competence, is authorized to conclude economic transactions in accordance with the university's budget;

 b) Participates in the development of the University's strategic and action plans and in the processes of monitoring and evaluating their implementation;

 c) Is responsible for the legality and efficiency of the University's economic activities;

 d) Is authorized to develop proposals for amendments to this Regulation and submit them to the Academic Council for consideration;

 e) Develops and submits to the Rector for approval the mechanisms for ensuring order, fire safety and medical assistance at Tbilisi Humanitarian University;

 f) Supplying the University with organizational, material and technical, stationery and other necessary inventory, and making purchases;

 g) Controls and supervises the supply of equipment and consumables necessary for the implementation of the educational process, in accordance with the number of students;

 h) Performs other functions stipulated by the legal acts of the University.

 5. The Head of Administration is accountable to the Founder, Rector, and Academic Council.

 6. The grounds for early termination of the authority of the head of the administration are:

 a) Motivated decision of the Academic Council;

 b) Motivated decision of the founder.

  

Article 13. Quality Assurance Service

1. The University Quality Assurance Service shall implement the internal university policy of quality assurance, using appropriate mechanisms that ensure the quality of teaching and research work and the professional development of staff.

2. The University Quality Assurance Service manages the university's authorization and accreditation processes.

 3. The University Quality Assurance Service cooperates with national and foreign educational institutions in the field of quality assurance.

 4. The Head of the University Quality Assurance Service is appointed by order of the Rector.

 5. The Head of the Quality Assurance Service is accountable to the founder, the rector, and the Academic Council.

 6. The grounds for early termination of the authority of the Head of the University Quality Assurance Service are:

 a) Motivated decision of the Academic Council;

 b) Motivated decision of the founder.

 

 

Chapter 3. University Structure

 

Article 14. University Structure

1. The structure of the University, as well as any changes to it, is approved by the Academic Council of the University upon the proposal of the founder.

 2. Description of the university structure:

 a) The governing bodies and officials of the University are determined by paragraph 2 of Article 7 of these Regulations;

 b) The main educational structural unit of the university is the faculty;

 c) There are 2 faculties operating at the university:

  • Law, Business, Humanities and Social Sciences;
  • Healthcare.

d) The structural units of the University are:

  • Library;
  • Research and Development Center;
  • Educational Process Management Service;
  • Quality Assurance Service;
  • Human Resources Management Service;
  • Public Relations Office;
  • International Relations Office;
  • Student Support and Career Development Office;
  • Legal service;
  • Chancellery;
  • Financial Service;
  • Services Office;
  • Medical assistance service;
  • Continuing Education Center;

3. University departments, faculties, clinics, as well as the library, conduct their activities in accordance with these regulations and their own regulations.

 4. A schematic version of the University structure is attached to this Regulation (Appendix No. 1) and is published on the University website.

 5. A person convicted of committing a crime against sexual freedom and inviolability as provided for in the Law of Georgia "On Combating Crimes against Sexual Freedom and Inviolability" and/or a person who has been deprived of the right to work in an educational institution by a court on the basis of the same law may not be employed in a higher educational institution.

 

Article 15. Faculty

1. A faculty is the main educational unit of a university, the structure and functions of which are determined by the faculty statute.

 2. The Faculty Council is the representative body of the Faculty. The Faculty Council consists of academic staff elected at the Faculty (Professor, Associate Professor, Assistant Professor, Assistant). The Faculty Council is chaired by the Dean of the Faculty. The Faculty Council also includes 2 students nominated by the Student Self-Government;

 

3. Faculty Council:

a) Is authorized to determine the educational programs to be implemented at the faculty;

 b) Review educational programs based on the approval of the Quality Assurance Service and the Dean of the Faculty and submit them to the Academic Council for approval;

 c) Determines and submits to the Academic Council the financial and budgetary requirements of the faculty;

 d) Approves the strategic and action plan for the development of the faculty;

 e) Upon the recommendation of the Dean, develops the Faculty Statute (with faculty structure) and submits it to the Academic Council for approval;

 f) is entitled, upon the request of at least 2/3 of the members of the Faculty Council, to apply to the Rector for the early termination of the Dean's authority on the grounds of improper performance of the duties assigned to the Dean and/or the implementation of activities inappropriate for the Dean;

 g) Exercises other powers granted to him/her by these regulations and the Faculty regulations.

  

Article 16. Dean of the Faculty

 

1. The Dean of the Faculty is appointed to the position by the Rector with the agreement of the founder; the term of office of the Dean of the Faculty is 4 years.

 

2. A person with a doctoral degree or an equivalent scientific degree, who is a member of the academic staff of the faculty, may be appointed as a dean.

 3. Dean of the Faculty:

 a) Ensures the effective conduct of the educational process at the faculty;

 b) Submits the Faculty Development Action Plan, educational programs, and Faculty Regulations to the Faculty Council for consideration;

 c) Within the scope of his/her competence, he/she is responsible for implementing the decisions of the Academic Council and the Faculty Council;

 d) issues written resolutions and service instructions within the scope of its competence;

 e) Exercises other powers granted to him/her by these regulations and the faculty regulations.

 4. The term of office of the Dean of the Faculty may be terminated early in the following cases:

 a) By a joint motivated decision of the rector and the founder;

 b) By his/her own statement;

 c) In case of termination of the employment contract for an academic position;

 d) In the event of death, declaration of death, recognition as missing, or other cases provided for by law.

  

Article 17. Laboratory, clinic and/or office

 

1. A laboratory, clinic, office is a structural educational and/or research unit of the faculty, the existence of which is envisaged by the educational program implemented by the faculty.

 

2. The rules of operation of a laboratory, clinic, or office are determined by the faculty regulations or the laboratory, clinic, or office regulations approved by the faculty council.

 

 

Chapter 4. Human Resources

 

Article 18. Administrative personnel

 

1. The administrative staff of the university includes:

 Rector;

Vice-Rector;

Head of Administration;

Head of Quality Assurance Service;

Dean of the Faculty.

2. The appointment of university administrative personnel (except for the Rector) to positions is made by order of the Rector.

 3. Employment contracts are concluded with the administrative staff of the university.

 4. The founder signs an employment contract with the university rector.

 5. In exceptional cases, by decision of the Rector, an administrative position holder may simultaneously hold another administrative position or be the head of another structural unit of the University.

 

 Article 19. Academic staff

 

1. Academic staff

 a) The academic staff of Tbilisi Humanitarian University consists of professors, associate professors, assistant professors and assistants;

 b) Professors, associate professors and assistant professors participate in the teaching process and/or scientific research and/or conduct them;

 c) Under the guidance of an assistant professor, associate professor or assistant professor, he/she carries out seminar and research work within the framework of the ongoing educational process in the main educational unit.

 d) The number of academic staff of the University is determined by the University's staffing schedule.

 2. Rules for holding an academic position

 a) Academic positions are filled only through open competition, which is conducted in accordance with the principles of openness, equality and fair competition;

 b) Academic positions of Professor and Associate Professor are held for a term of 4 years;

 c) The academic positions of Assistant Professor and Assistant are held for a term of 3 years;

 d) The decision to hold an open competition, including the date and the selection committee, is made by the Academic Council upon the request of the faculties;

 e) The competition conditions are established by the Academic Council, taking into account the proposals of the faculties, the requirements specified by the legislation of Georgia and these regulations;

 f) An order of the Rector shall be issued announcing an open competition;

 g) The date of the competition and the competition conditions are published at least 1 month prior to the receipt of competition applications and attached documents, in accordance with the procedure established by the legislation of Georgia.

 3. Professor

 3.1. A person may be elected to the academic position of professor for a period of 4 years if:

 

a) Is a person with a doctoral degree or an equivalent academic degree;

 b) Has at least 6 years of experience in scientific and pedagogical work, and in the case of single-level educational programs, additional clinical experience - at least 9 years;

 c) Has published 3 scientific papers in the last 5 years, which confirm his/her competence in the relevant field;

 d) Presents the syllabus/syllabuses prepared in the academic discipline envisaged by the educational program implemented by the relevant faculty in electronic and printed form;

 e) Meets other competition conditions approved by the Georgian legislation and/or the Academic Council of THU.

 3.2. A person may be elected to the academic position of professor for life if:

 a) Meets the requirements set forth in Subsection 3.1 of this Article;

 b) Has exceptional professional and/or scientific achievements (for example, has scientific publications in leading local and international journals and other publications, has participated in national and international scientific research projects, etc.);

 c) Agrees to undergo mandatory certification once every 5 years, in accordance with the procedure established by this Regulation.

 4. Associate Professor

 4.1. A person may be elected as an associate professor for a term of 4 years if:

 a) is a person with a doctoral degree or an equivalent academic degree;

 b) Has at least 3 years of experience in scientific and pedagogical work, and in the case of single-level educational programs, additional clinical experience - at least 5 years;

 c) Has published 2 scientific papers in the last 5 years, which confirm his/her competence in the relevant field;

 d) Presents the syllabus/syllabuses prepared in the academic discipline envisaged by the educational program implemented by the relevant faculty in electronic and printed form;

 f) Meets other competition conditions approved by the Georgian legislation and/or the Academic Council of THU.

 5. Assistant Professor

 5.1. A person may be elected as an assistant professor for a term of 3 years:

 a) who is a person with a doctoral degree or an equivalent academic degree, who has at least 2 years of experience in scientific and pedagogical work and has published 1 scientific paper in the last 5 years, which confirms his/her competence in the relevant field;

 b) Has appropriate qualifications, which are confirmed by professional experience, special training and/or publications; a person shall be considered to have appropriate qualifications if he/she has the competence necessary to produce the learning outcomes envisaged by the program, which is confirmed as follows:

 b.a) Has 3 years of professional experience and special training, and/or

 

b.b) Has published at least 2 publications in the last 5 years, which confirm his/her competence in the relevant field and has at least 1 year of experience in scientific or pedagogical work, and in the case of single-level educational programs, additional clinical experience - at least 3 years;

 5.2. The candidate for assistant professorship must submit the syllabus/syllabuses prepared in the academic discipline envisaged by the educational program implemented by the relevant faculty in electronic and printed form.

 5.3. A candidate for the position of Assistant Professor must meet other competition conditions stipulated by Georgian legislation and/or approved by the Academic Council of THU.

 6. Assistant

 6.1. A person may be elected as an assistant for a term of 3 years if:

 a) Is a person with a doctoral degree or an equivalent academic degree or is a doctoral candidate and/or has relevant qualifications, which are confirmed by professional experience, special training and/or publications; a person shall be considered to have relevant qualifications if he/she has the necessary competence to produce the learning outcomes envisaged by the program, which is confirmed as follows:

 

– has 2 years of professional experience and special training, and/or

 – Has published a publication within the last 5 years that confirms his/her competence in the relevant field, and in the case of single-level educational programs, additional clinical experience - at least 3 years;

 b) Meets other competition conditions stipulated by Georgian legislation and/or approved by the THU Academic Council.

 7. Rules for conducting an open competition

 a) An open competition for the selection of academic personnel is held in compliance with the requirements specified in the Law of Georgia "On Higher Education";

 b) The decision to announce an open competition is made by the Academic Council of THU, upon the request of the faculties, on the basis of which a rector's order is issued, which must reflect:

 – Date of announcement of the open competition;

 – Number and direction of vacancies;

 – Qualification requirements and competition documentation to be submitted for candidates, including additional qualification requirements for the election to the academic position of professor for life and additional competition documentation to be submitted, additional qualification requirements for academic personnel selected for foreign language educational programs and additional competition documentation to be submitted;

 – Dates for the start and end of the submission of competition applications; Place for submission of applications;

 – Rules for publishing the decision of the competition commission;

 – Rules for ensuring the publicity of the competition.

 

c) A competition commission is established by the decision to announce an open competition, which is formed from the dean of the relevant faculty, the head of the program, and persons with a doctorate degree who are employed in full-time academic positions at THU. The competition commission also includes a person who does not hold an academic position at THU, who is determined by the decision of the competition commission as the chairman of the competition commission, and the secretary of the commission is also determined at the same meeting;

 d) The quorum of the competition commission is if at least half of the full composition of commission members present at the meeting;

 e) The chairperson of the competition commission shall convene the meeting of the competition commission;

 f) Minutes of the meeting of the Competition Commission shall be drawn up, which shall be signed by the Chairman and members of the Competition Commission;

 g) The Competition Commission shall consider the compliance of the submitted applications and attached documentation with the competition conditions and determine whether there are grounds for disqualification of the contestant; the Competition Commission shall make a decision on the disqualification of the contestant with the consent of more than half of the total membership; in the event of an equal division of votes, the vote of the Chairman of the Competition Commission shall be decisive;

 h) At the meeting of the Competition Commission, the submitted competition applications and attached syllabi/scientific papers are distributed among the members of the Competition Commission according to their profile, for study and conclusion;

 i) At the meeting of the competition commission, the submitted competition applications and conclusions drawn up regarding the contestants are reviewed and evaluated;

 j) Each applicant for the position of Professor and Associate Professor is evaluated within 10 points, where 4 points are distributed on pedagogical experience and professional achievements, 3 points – on scientific achievements, 3 points – on the presented syllabi and the teaching methodology reflected therein; the applicant for the position of Assistant Professor is evaluated in the same way or on the basis of professional experience and special training and/or an analysis of publications and scientific or pedagogical experience – also within 10 points; the applicant for the position of Assistant is evaluated on the basis of academic degree, professional experience and special training and/or an analysis of publication(s) within 10 points;

 k) Each contestant is evaluated individually by the members of the competition commission, after which their average rating score is calculated;

 m) The candidate /candidates who accumulate the highest rating points, but not less than 5, will be declared as the winner;

 n) In the event that only one applicant has submitted an application for a vacant academic position, he/she will be declared the winner if his/her average score is not less than 5;

 n) In the event that more than one candidate obtains the same rating score for the same vacancy, the competition commission shall re-evaluate these candidates at an additional meeting; in this case, the competition commission shall be authorized to interview the relevant candidates; the winner (the preferred candidate) shall be determined in accordance with subparagraphs k), k) and m) of this paragraph;

 p) The competition commission shall develop a substantiated conclusion regarding the election of professors for life, based on their applications and the submitted and studied additional competition documentation, regarding the professors who won the competition, which shall be reflected in the minutes of the meeting;

 p) The decision of the Competition Commission shall be made by a majority of the full composition of the Competition Commission; in the event of an equal division of votes, the vote of the Chairman of the Competition Commission shall be decisive; the decision of the Competition Commission shall not be subject to separate appeal. The Rector's order on the appointment of academic personnel to a position shall be subject to appeal in accordance with the procedure established by the legislation of Georgia.

 8. Mandatory certification of a professor elected for life

 8.1. The purpose of mandatory attestation is to confirm the exceptional professional and/or scientific achievements of a tenured professor (repeated recognition);

 8.2. A professor elected for life shall undergo mandatory attestation once every 5 years;

 8.3. Mandatory attestation is conducted within the framework of the relevant educational unit (faculty);

 8.4. The composition of the attestation commission and the terms of its conduct, upon the nomination of the dean of the relevant faculty, are approved by the Rector of the University by order; The composition of the attestation commission is formed on a professional/specialty basis, from persons with a doctoral academic degree, and it cannot include persons holding academic positions at the relevant faculty; The same order determines the chairman and secretary of the attestation commission;

 8.5. The quorum of the Attestation Commission is if at least half of the full composition of the Commission members is present at the meeting;

 8.6. The attestation commission/commissions shall operate in accordance with the procedure specified for the competition commission by these regulations; decisions shall be made by a majority of the full membership of the commission;

 8.7. The following documentation shall be submitted to the Attestation Commission by a professor elected for life:

 a) Scientific paper/papers published in leading local and international journals and other publications within the last 5 years;

 b) Documentation confirming participation in national and international scientific research projects, with a description of the format of participation;

 c) Textbooks/auxiliary textbooks/monographs published in the last 5 years;

 d) Updated syllabus/syllabuses of the academic discipline/disciplines provided for in the educational program;

 8.8. During mandatory attestation, the Quality Assurance Service shall submit to the Attestation Commission the latest results of the evaluation of the educational program in the implementation of which the person is involved;

 

8.9. The decision of the Attestation Commission is based on the documentation submitted by the professor, as well as the data available at the university, and the latest results of the evaluation of the educational program in which the professor is involved;

 8.10. The following components are evaluated by the competition commission: professional achievements, scientific achievements;

 8.11. Each component is assessed using one of the following assessments:

 a) Good - fully compliant;

 b) Satisfactory - mostly appropriate;

 c) Unsatisfactory - inappropriate.

 8.12. The Attestation Commission makes the following consolidated decision for each professor subject to attestation:

 a) The professor's exceptional professional/scientific achievements are fully confirmed (with good grades in both components);

 b) The professor's exceptional professional/scientific achievements are partially confirmed (with a satisfactory assessment, it is required to fulfill the recommendations of the attestation commission in one or both components);

 c) The professor's exceptional professional/scientific achievements are no longer confirmed (in one of the components - when receiving an unsatisfactory assessment).

 8.13. In the event that the Attestation Commission determines that a person is no longer suitable for the academic position held, the Rector shall, by order, terminate the permanent employment contract concluded with this person ahead of time, in accordance with the procedure established by the legislation of Georgia; this does not limit the person's right to:

 a) Transfer to a fixed-term employment contract, but not more than 4 years from the date of appointment as a professor;

 b) To occupy the academic position of professor at THU on a fixed-term basis through an open competitive procedure;

 8.14. The decision provided for in subparagraph b) of paragraph 8.12 of this Article may be appealed in court;

 8.15. The decision provided for in subparagraph c) of paragraph 8.12 of this article shall be appealed together with the order of the rector provided for in paragraph 8.13 of the same article.

 9. Forms of employment contracts concluded with academic staff are approved by order of the Rector.

 10. Issues of affiliation of academic personnel are regulated in accordance with the rules approved by the Academic Council of the University.

 11. (Removed)

 12. Amount and conditions of remuneration of academic staff

 a) The amount of remuneration for a person appointed to an academic position, as well as the terms of payment, shall be determined individually on the basis of the employment contract concluded between the employer and the employee;

 

b) The employer and the employee are authorized to agree on special conditions for determining the salary (according to the academic position held, according to the volume of hourly workload, etc.);

 13. Academic staff has the right to:

 a) Participate in the management of the higher education institution in accordance with this Regulation;

 b) To carry out teaching, research, creative activities and the publication of scientific works without interference;

 c) Independently determine the content of the curriculum (syllabus), teaching methods and means of instruction within the framework of the educational program;

 d) Use other powers granted to them by the legislation of Georgia.

 14. Academic staff is obliged to:

 a) Comply with the requirements of these regulations and the acts regulating the educational process in force at the university;

 b) To comply with the university's internal regulations and ethical norms;

 c) Fulfill the obligations assumed under the employment contract;

 d) Submit a report on the work performed after professional development and/or scientific-creative leave.

 15. The University provides:

 a) Scientific, research and academic freedom of academic staff;

 b) Creates appropriate conditions for its activities.

 16. The grounds for dismissal of academic staff and termination of employment contracts concluded with them are determined by the Labor Code of Georgia, the Law of Georgia "On Higher Education" and, in certain cases, also by this Regulation.

 17. In accordance with paragraphs 4 and 5 of Article 35 of the Law of Georgia "On Higher Education", a person without an academic degree may also be elected to an academic position based on professional qualifications.

 17 . Criteria for confirming professional qualification:

 1. For the academic position of Associate Professor:

 a) Master's degree or equivalent academic degree;

 b) At least 5 years of work experience in the relevant field, which is related to practical work in leading positions in the field ( the content of practical work may be specified depending on the specifics of the program);

 c) Scientific publication(s) published within the last 10 years on the topic of the relevant course(s);

 d) Vision of academic activities.

 2. For the academic position of Assistant Professor:

 a) Master's degree or equivalent academic degree;

 b) At least 3 years of work experience in the relevant field, which is related to practical work in leading positions in the field (the content of practical work may be specified depending on the specifics of the program);

 c) Scientific publication(s) published within the last 10 years on the topic of the relevant course(s);

 d) Vision of academic activities.

 18. A candidate participating in the competition must submit to the competition committee:

 a) Statement;

 b) Copy of ID card;

 c) CV (resume), printed and electronic (in Georgian);

 d) Copies of the diploma/other diplomas confirming the award of an academic degree; in the case of a foreign language diploma – in a form certified by an apostille;

 e) Certificates confirming teaching experience;

 f) Syllabus/syllabuses in printed and electronic form in the form approved by Tbilisi Humanitarian University;

 g) A list of scientific papers/articles published in the last 5 years (printed and electronic versions), confirming his/her competence in the relevant field, otherwise - confirmed by personal signature, with the attachment of the title page, table of contents and article excerpts of all papers;

 h) Certificate of conviction (according to Article 32, Paragraph 2 of the Law of Georgia "On Higher Education", a person convicted of committing a crime against sexual freedom and inviolability as provided for in the Law of Georgia "On Combating Crimes against Sexual Freedom and Inviolability" and/or a person who has been deprived of the right to work in an educational institution by a court on the basis of the same law may not be employed in a higher educational institution);

  

Article 19 1. Competition Criteria for Academic Staff of Foreign Language Programs

 

1. For a competition announced for the implementation of a foreign language program or a foreign language component of the program, an additional criterion is established for the contestant to prove their language competence in the language of implementation of the relevant component of the program, if the said language is not the contestant's native language.

 2. A candidate's foreign language proficiency will be considered confirmed in one of the following cases:

 a) In case of presentation of a document confirming higher education obtained in the relevant language;

 b) In case of submission of a document confirming the experience of teaching a higher education program/course in the relevant language;

 c) In the case of submission of an internationally recognized certificate of language competence, which confirms the candidate's proficiency in the relevant language at least at the B2 level, in accordance with the competence descriptors established by the Common European Framework of Reference for Languages ( CEFR) .

 d) In case of presentation of a certificate confirming the experience of teaching a course in a foreign language program for three years at any higher educational institution authorized in Georgia;

 3. One of the following shall be considered an internationally recognized certificate confirming possession of language competence at level B2, as provided for in subparagraph "c" of paragraph 2 of this Article:

 a ) Cambridge English First (FCE),

 b ) BEC Vantage,

 c ) IELTS 5-6.5,

 d ) TOEFL iBT 87-109, 

 e ) Michigan ECCE,

 f ) PTE General Level 3,

 g ) PTE Academic 59-75,

h ) Trinity ISE II 4.

 

4. A participant in an academic competition who fails to prove language competence in accordance with the procedure established in paragraphs 2 and 3 of this Article is obliged to give a demonstration lecture in a foreign language before the commission or to pass a language competence test through an examination test prepared by the teaching university. The test questions and competence threshold are determined by the teaching university.

5. In the case of single-level educational programs, the competition criteria for academic staff of foreign language programs are confirmed as follows:

a) At least 3 years of experience teaching a foreign language program (corresponding to the language of instruction of the program) or

b) Carrying out medical activities in a clinic operating abroad in the language of instruction of the program for at least 1 year or

c) Implementation of a teaching/research activity program in the field of biomedicine in a research institution operating abroad in the language of instruction for at least 1 year or

d) Completion of an undergraduate or postgraduate program in the language of instruction of the program, with a certified document or

e) An internationally recognized certificate confirming knowledge of the language of instruction of the program at least at B2 level or

f) Confirmation of language proficiency by the educational institution, with the involvement of relevant specialists, based on an internal university exam corresponding to the B2 level of the language of instruction of the program;

 

Article 20. Honorary Doctorate

The Academic Council of the University is authorized to award the title of Honorary Doctor of Tbilisi Humanitarian University to a scientist or public figure for exceptional merit.

 

Article 21. Invited ( non-staff ) personnel

 

a) Based on Article 40, Paragraph 6 of the Law of Georgia "On Higher Education", upon the request of the relevant faculty, it is possible to invite specialists with appropriate qualifications to participate in the educational process in educational programs implemented by the same faculty, without taking them into account in the staffing schedule (non-staff), on the basis of an employment contract, on an hourly basis;

 b) Invited non-tenured personnel – invited professor, invited associate professor; invited assistant professor; invited assistant;

 c) Upon the request of the relevant faculty, academic staff from other faculties with the same academic position (visiting professor/visiting associate professor/visiting assistant professor/visiting assistant) may be invited to educational programs implemented by the same faculty;

 d) A fixed-term employment contract is concluded with the invited personnel for 1 academic year or semester;

 e) The grounds for dismissal of invited (non-staff) personnel and termination of the employment contract concluded with them are determined by the Labor Code of Georgia, the Law of Georgia "On Higher Education" and, in certain cases, also by this Regulation.

 f) A fixed-term employment contract is concluded with the invited personnel for 1 academic year or semester;

 g) The grounds for dismissal of invited (non-staff) personnel and termination of the employment contract concluded with them are determined by the Labor Code of Georgia, the Law of Georgia "On Higher Education" and, in certain cases, also by this Regulation.

 

Article 22. Support staff

 

1. Support staff includes persons necessary for the activities of the university, as provided for in the university staff list.

 2. The appointment of support personnel to positions is carried out by order of the Rector; an employment contract is concluded with them in accordance with the procedure established by the legislation of Georgia.

 3. Persons may be employed on the basis of an employment contract for auxiliary positions not provided for in the university's staff list, depending on the needs of the university.

 

Chapter 5. Student

 

Article 23. Student rights

 

1. The student has the right to:

 a) Receive a quality education;

 b) Participate in the research;

 c) to use the material-technical, library, information and other resources of the higher educational institution under equal conditions, in accordance with the rules established by the University's statute, internal regulations and other internal university acts;

 d) To elect a representative by secret ballot on the basis of universal, direct and equal elections and to be elected to the Student Self-Government and Faculty Councils in accordance with these Regulations;

 e) Freely establish and/or join student organizations on their own initiative;

 f) Freely express one's own opinion and reasonably refuse to share ideas offered during the learning process;

 g) Receive a scholarship or other benefit from the state, the university or other sources in accordance with the legislation of Georgia and the internal regulations of the university;

 h) Choose an educational program;

 i) Participate in the development of an individual educational program;

 j) Exercise other powers granted to it by the legislation of Georgia;

 2. The University establishes the necessary conditions for full-fledged education for students with disabilities, which are determined by the current legislation; Free movement of students with disabilities within the University is ensured; In the event that it is impossible for a student with disabilities to move in any part of the University building, the University is obliged to provide the student with disabilities with the educational inventory located in this part of the University building in that part of the University building in which his easy movement is ensured; In the event that a student with disabilities cannot move to the office of the University staff, this staff is obliged to receive the student with disabilities in a convenient part of the University building for this student.

 3. Personal information expressed by a student in the presence of academic personnel, as well as information about his/her own views, beliefs and political beliefs, which became known to the latter during the educational process, as well as information about the implementation of disciplinary measures against the student, are confidential, except in cases where there is the student's permission or the university has a legitimate interest in protecting the safety of others and the rights protected by law. Information about a student's academic performance and the implementation of disciplinary measures against him/her must be kept separate.

 4. The University is prohibited from using its powers and material and technical resources in a manner that may create a threat of censorship or restrict freedom of expression, except in cases where the student's behavior contradicts the norms of student ethics that ensure the conduct of the educational process;

 5. Disciplinary action against a student shall be proportionate to the disciplinary offense and may be taken only in cases and in accordance with the rules and procedures provided for by the University's internal regulations, through a fair procedure. The University shall develop student ethical norms, which may impose restrictions on the student's behavior if this is related to the conduct of the educational process. The University shall be obliged to define in detail the rules of conduct that give rise to disciplinary liability.

  

 

 

Article 24. Student Responsibilities

 

1. The student is obliged to:

 a) To comply with the university's statutes and internal regulations;

 b) Implement the internal university acts related to the educational process, including decisions of the Academic Council and orders of the Rector;

 c) To fulfill the obligations assumed under the agreement signed with the University on educational services.

 2. The rules and conditions for suspending and terminating student status are determined in accordance with the "Rules for Obtaining, Suspending and Terminating Student Status, Mobility, and Recognition of Education Obtained during Study" approved by the Academic Council.

  

Article 25. Rights of Student Self-Government

 

1. Student self-government elected by faculties is established at the university on the basis of universal, equal, direct elections by secret ballot;

 2. The University Student Self-Government shall develop the Student Self-Government Regulations;

 3. Student self-government, in accordance with its regulations:

 a) Ensures student participation in the governance of the university through participation in the Faculty Council;

 b) Promotes the protection of students' rights;

 c) Is authorized to develop proposals for improving the management system and quality of teaching of the faculty or university, which are submitted to the Faculty Council and the Academic Council;

 d) Uses other powers provided for by the Student Self-Government Regulations.

 4. University management bodies do not have the right to interfere in the activities of student self-government.

 

Chapter 6. Basis for admission to the university

 

Article 26. General Rules for Admission of Students to Bachelor's and Graduate Dental one-level Educational Programs

 

1. Admission to the Bachelor's and Graduate Dentistry one-level educational program is based on the results of the Unified National Examinations, in accordance with the rules established by the legislation of Georgia, according to the list published by the LEPL National Center for Assessment and Examinations, except for exceptional cases provided for by the Law of Georgia "On Higher Education".

 2. In order to support applicants and promote student mobility, studying at a university without passing unified national exams is permitted only in cases specified by the Law of Georgia on Higher Education, in accordance with the procedure and within the established deadlines established by the Ministry of Education and Science of Georgia.

Chapter 7. Educational Programs

 

Article 28. Academic Higher Education Programs

 

1. The University implements the following academic higher education programs:

 a) Bachelor's degree programs (first level); In case of obtaining at least 240 credits in a bachelor's degree program, the student is awarded the academic degree of Bachelor; Only a person who holds a document confirming complete general education or an equivalent document has the right to study in a bachelor's degree; The goal of studying in a bachelor's degree, along with a higher level of professional training than in a complete general education, is to acquire a relatively deep understanding of the theoretical aspects of academic disciplines, which, through research-based programs, prepares a person for further study and work in a master's degree program, taking into account the restrictions established by the legislation of Georgia;

b) One-level higher education program of a graduate dentist, provided for by Article 471 of the Law of Georgia "On Higher Education" (equalized to the second level); in case of obtaining 300 credits in the one-level higher education program of a graduate dentist, the student is awarded the academic degree of a graduate dentist;

 2. An educational program typically includes 60 credits during one academic year.

 3. After completing each level of study, an appropriate diploma will be issued, with a standard appendix.

 4. A person who has not or has failed to complete the relevant educational level shall be issued with an appropriate certificate.

 5. The University is authorized to implement other educational programs, except for the doctoral educational program, on the basis of and in accordance with the legislation of Georgia.

 

Article 29. Language of Instruction

 

The language of implementation of the university's educational programs is Georgian, and in case of obtaining the relevant right in accordance with the procedure established by the legislation of Georgia, also a foreign language.

Chapter 8. Internationalization Policy

 

Article 30. Implementation of Internationalization Policy

 

1. The University promotes international mobility of academic staff; finances the business trips of academics to partner universities; invites or receives foreign lecturers within the framework of bilateral agreements.

 2. The University promotes student mobility to partner universities to enhance the educational component; invites or accepts foreign students within the framework of a bilateral agreement.

 3. In order to gain and share experience, it sends administrative staff to partner foreign universities.

 4. The university is activating cooperation with foreign higher education institutions and signing new agreements.

 5. The university organizes international summer schools and attracts foreign students.

                                              

 

Chapter 9. Reorganization and Liquidation of the University

 

Article 31. Procedure for Reorganization and Liquidation of the University

 

The reorganization or liquidation of the University is carried out in accordance with the University Charter, by decision of the University founder, and in accordance with the procedure established by the legislation of Georgia.
